Privacy Policy

Effective Date: October 16, 2026
Last Updated: October 16, 2026

This Privacy Policy (“Policy“) explains how DFSENDER LLC, a Wyoming limited liability company (“DFSENDER,” “we,” “us,” or “our“), collects, uses, discloses, retains, and protects personal information when you visit our websites or pages; submit an inquiry or request; make or manage a booking or appointment; request, purchase, or receive our services; accept an estimate or agreement; electronically sign a document; make a payment; communicate with us; receive communications from us; or otherwise interact with DFSENDER (collectively, the “Services“).

DFSENDER is responsible for the customer relationship and the processing of personal information described in this Policy.

We use the Office-X software platform to administer portions of our customer, booking, service, communication, document, electronic-signature, invoice, payment, and related business workflows. Office-X LLC acts as a service provider or processor to DFSENDER with respect to information it processes on our behalf. Office-X is not the provider of DFSENDER’s Services merely because we use its software.

This Privacy Policy should be read together with DFSENDER’s Terms of Service.

SMS/MMS Privacy and A2P 10DLC Notice

DFSENDER LLC may collect your mobile phone number when you provide it to us, including when you request services, communicate with us, make a booking or appointment, or voluntarily opt in to receive SMS/MMS communications.

We may use your mobile phone number to send communications that you have authorized, including customer-care, transactional, informational, and, where you separately consent, promotional or marketing messages.

We do not share, sell, rent, or provide your mobile phone number or messaging consent data to third parties or affiliates for marketing or promotional purposes.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except service providers that support the delivery of our messaging program or as required by law.

Any service provider that processes mobile information on our behalf does so only as necessary to provide, maintain, secure, or support our messaging services and is not authorized by DFSENDER LLC to use mobile information or messaging consent for its own marketing or promotional purposes.

Message frequency varies. Message and data rates may apply.

You may opt out of SMS/MMS communications at any time by replying STOP. For assistance, reply HELP or contact DFSENDER LLC at 469-638-5060 or [email protected].

Consent to receive marketing or promotional text messages is not a condition of purchasing goods or services from DFSENDER LLC.

1. Personal Information We Collect

The personal information we collect depends upon how you interact with DFSENDER and the Services.

We may collect the following categories of information.

We may collect:

  • name;
  • business or company name;
  • email address;
  • mobile or other telephone number;
  • postal address;
  • billing address;
  • service address;
  • account or customer identifiers; and
  • other contact information you provide.

1.2 Request, Booking, and Service Information

We may collect information concerning:

  • inquiries and requests;
  • bookings and appointments;
  • scheduling preferences;
  • service instructions;
  • assessments;
  • projects and tasks;
  • service or work visits;
  • personnel assignments;
  • notes;
  • files and documents;
  • photographs;
  • customer/client portal activity; and
  • other information you or authorized personnel provide in connection with the Services.

1.3 Commercial and Transaction Information

We may collect:

  • Services requested or purchased;
  • estimates and quotations;
  • agreements and Service Orders;
  • invoices;
  • amounts charged or paid;
  • payment status;
  • transaction identifiers;
  • receipts;
  • refunds;
  • disputes and chargebacks; and
  • service and transaction history.

Payment processors generally collect and process complete payment credentials directly. DFSENDER ordinarily receives more limited transaction information necessary to administer the transaction.

1.4 Communications and Preferences

We may collect and maintain:

  • emails;
  • SMS/MMS messages;
  • customer-support communications;
  • inquiries and responses;
  • message content;
  • delivery and status information;
  • communication preferences;
  • email marketing selections;
  • transactional/informational SMS selections;
  • promotional/marketing SMS selections; and
  • opt-in and opt-out activity.

1.5 Consent and Preference Records

DFSENDER may maintain records reasonably necessary to establish and demonstrate consent and communication preferences, including:

  • telephone number or email address;
  • communication channel;
  • messaging program selected;
  • purpose or category of communications selected;
  • whether consent was granted or withdrawn;
  • exact or substantially equivalent consent disclosure presented;
  • date and time of consent;
  • date and time of withdrawal;
  • method through which consent was obtained;
  • form, page, campaign, or other source of consent;
  • IP address;
  • browser and device information;
  • audit events;
  • STOP, START, HELP, unsubscribe, and similar activity; and
  • other records reasonably necessary to demonstrate your choices.

These records are particularly important for maintaining evidence of SMS consent and honoring opt-outs.

1.6 Electronic Signature and Document Records

If you electronically accept an estimate or sign an agreement, we may collect:

  • signer name;
  • electronic signature, signature image, or electronic mark;
  • document contents;
  • electronic-signature disclosure acceptance;
  • timestamps;
  • IP address;
  • browser or device information;
  • authentication or verification information; and
  • associated document and audit history.

1.7 Technical, Device, and Usage Information

When you use our websites, forms, customer portals, or other online Services, we or our service providers may automatically collect:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • device and session identifiers;
  • referring and exit pages;
  • dates and times of access;
  • pages or features used;
  • clicks and interactions;
  • log information;
  • security events;
  • approximate geographic location inferred from IP address;
  • cookie identifiers; and
  • similar technical and usage information.

1.8 Information About Other People

You may sometimes provide information about another person.

You are responsible for ensuring that you have appropriate authority or another lawful basis to provide that information to DFSENDER.

2. Sources of Personal Information

We may obtain personal information:

  • directly from you;
  • from a person or organization acting on your behalf;
  • from DFSENDER personnel;
  • automatically through your interaction with our websites and Services;
  • through Office-X;
  • from communications providers;
  • from payment processors;
  • from hosting, security, email, scheduling, document, electronic-signature, analytics, and other service providers;
  • from business partners where permitted by law; and
  • from publicly available sources where permitted by law.

Receiving your telephone number, email address, or other contact information from a public source, business partner, existing customer record, another person, or another system does not by itself constitute consent to receive marketing email or SMS/MMS messages.

SMS and marketing consent is obtained according to the applicable consent mechanism described below.

3. How and Why We Use Personal Information

DFSENDER may use personal information to:

  • respond to inquiries and requests;
  • identify and authenticate customers;
  • establish and maintain customer records;
  • provide and administer Services;
  • schedule and manage bookings and appointments;
  • coordinate personnel, projects, tasks, and service visits;
  • prepare estimates and agreements;
  • obtain electronic signatures;
  • generate and administer invoices;
  • process and record payments and refunds;
  • provide receipts;
  • respond to payment disputes;
  • provide customer support;
  • send authorized service, account, transactional, informational, security, verification, and customer-care communications;
  • send marketing communications where permitted by law and consistent with your communication choices;
  • maintain evidence of consent;
  • maintain suppression and opt-out records;
  • honor communication preferences;
  • prevent unwanted communications;
  • administer our websites, forms, and customer portals;
  • analyze and improve our Services and business operations;
  • troubleshoot technical problems;
  • maintain records and audit trails;
  • train personnel;
  • secure our systems, Services, and users;
  • detect, investigate, and prevent fraud, abuse, security incidents, and unlawful activity;
  • enforce agreements;
  • establish, exercise, or defend legal claims;
  • comply with applicable laws, legal process, carrier requirements, and regulatory obligations; and
  • evaluate or complete a merger, financing, acquisition, reorganization, sale, or other business transaction subject to the mobile-information restrictions contained in this Policy.

Where applicable law requires a legal basis for processing, we may rely, as appropriate, upon performance of a contract or steps requested by you, compliance with legal obligations, legitimate interests in operating and protecting our business and Services, or your consent.

Where processing is based upon consent, you may withdraw that consent as permitted by law. Withdrawal does not affect processing that was lawful before withdrawal.

4. DFSENDER Communication Consent Structure

DFSENDER LLC (“DFSENDER”) obtains communication consent through separate, voluntary opt-in processes. Depending on the communication channel and Services requested, consent may be collected through DFSENDER’s online booking forms or through its AI phone receptionist during telephone bookings.

DFSENDER distinguishes among four separate types of acceptance and communication preferences:

  1. Acceptance of DFSENDER’s Terms of Service and acknowledgment of this Privacy Policy;
  2. Consent to marketing or promotional email;
  3. Consent to transactional/informational Customer Care SMS/MMS; and
  4. Consent to promotional/marketing SMS/MMS.

Acceptance of the Terms of Service or acknowledgment of this Privacy Policy does not, by itself, constitute consent to receive SMS/MMS or marketing communications.

4.1 Online Booking Forms

When DFSENDER offers communication enrollment through an online booking form, marketing email, transactional/informational SMS/MMS, and promotional/marketing SMS/MMS are presented as separate, optional consent choices, as applicable.

These communication-consent checkboxes are unchecked by default and are not required to submit a booking or request Services.

When a mobile telephone number is provided, the Customer Care SMS and promotional/marketing SMS options are presented separately. Selecting one does not select or authorize the other.

A separate required checkbox may be used to accept DFSENDER’s Terms of Service and acknowledge this Privacy Policy. This legal acceptance does not constitute consent to receive SMS/MMS or marketing email.

Providing a mobile number, including through a required or optional telephone-number field, does not by itself enroll the individual in an SMS/MMS program.

4.2 Telephone Bookings, Legal Acceptance, and Verbal SMS Consent

When DFSENDER provides telephone booking services through its AI phone receptionist, acceptance of DFSENDER’s Terms of Service, acknowledgment of this Privacy Policy, and consent to receive SMS/MMS communications are handled as separate actions.

Terms of Service and Privacy Policy

Before completing a booking that requires acceptance of DFSENDER’s Terms of Service, the AI receptionist provides callers with the following publicly accessible policy references:

Terms of Service: https://dfsender.com/terms/

Privacy Policy: https://dfsender.com/privacy/

Callers are given an opportunity to review these documents before being asked to accept the Terms of Service and acknowledge this Privacy Policy.

Where required for the booking, the receptionist requests a clear affirmative response confirming Terms acceptance and Privacy acknowledgment.

Acceptance of the Terms of Service and acknowledgment of this Privacy Policy do not constitute consent to receive SMS/MMS or marketing communications.

Separate Optional SMS Consent

The AI receptionist separately explains the DFSENDER Customer Care SMS program, including the sender’s identity, message purposes, recurring-message frequency, potential message and data charges, HELP and STOP instructions, and the voluntary nature of enrollment.

Before requesting SMS consent, the receptionist also explains that DFSENDER does not share, sell, rent, or provide mobile phone numbers or messaging consent data to third parties or affiliates for marketing or promotional purposes.

The receptionist then requests a separate, clear affirmative response specifically authorizing Customer Care SMS messages.

Silence, an ambiguous response, acceptance of the Terms of Service, acknowledgment of this Privacy Policy, or merely providing a mobile telephone number does not constitute SMS consent.

Callers may decline SMS enrollment and still request or book Services, subject to any separate service-contract requirements.

Verbal consent to Customer Care SMS does not authorize promotional or marketing SMS messages.

4.3 Consent Is Program-Specific

Consent obtained through an online form or AI phone receptionist applies only to DFSENDER, the applicable telephone number or email address, the selected communication program, and the purposes disclosed when consent was obtained.

Transactional/informational Customer Care SMS consent and promotional/marketing SMS consent are separate and are not interchangeable.

DFSENDER does not treat consent to one communication channel, sender, or purpose as consent to another.

Consent to receive marketing or promotional communications is not a condition of purchasing goods or Services from DFSENDER.

Individuals may withdraw communication consent as described in Section 6 and Section 17 of this Policy.

5. Marketing and Promotional Email

Where offered, DFSENDER may present a separate optional marketing-email consent option substantially similar to:

I agree to receive marketing and promotional emails from DFSENDER LLC.

Selecting this option authorizes DFSENDER to send marketing and promotional emails to the email address provided.

Leaving this option unchecked does not prevent you from requesting or purchasing Services, provided that you complete other required fields and legal acceptance requirements.

Email marketing consent does not constitute SMS consent.

DFSENDER may separately send nonmarketing email where permitted by law and reasonably necessary to:

  • respond to your inquiry;
  • administer a request or transaction;
  • provide Services;
  • provide customer support;
  • send security information;
  • provide estimates, agreements, invoices, receipts, or other transaction information; or
  • communicate concerning an existing customer relationship.

Promotional emails will provide an unsubscribe method where required by applicable law.

6. SMS/MMS Messaging and Consent

6.1 DFSENDER Customer Care SMS Program

DFSENDER LLC operates the DFSENDER Customer Care SMS program, which provides recurring transactional, informational, and customer-care SMS/MMS communications to individuals who have provided the applicable consent.

Messages may include:

  • Account notifications and status updates;
  • Customer-support messages and follow-ups;
  • Service requests and assessment updates;
  • Booking and appointment confirmations;
  • Appointment reminders;
  • Scheduling changes and cancellations;
  • Service-visit and arrival notifications;
  • Estimates and estimate follow-ups;
  • Agreements and electronic-signature requests or status updates;
  • Invoices and billing reminders;
  • Receipts and payment confirmations;
  • Requested security or verification messages; and
  • Customer or client portal and related service notifications.

This Customer Care program does not send promotional or marketing messages. Promotional/marketing SMS consent is collected separately and is not used as consent for this program.

Online Booking Consent

Individuals may enroll through DFSENDER’s online booking process, accessible from https://dfsender.com/ by selecting “Book an appointment.”

The booking form is provided using the Office-X platform.

The individual may provide a mobile telephone number and affirmatively select a separate, optional, unchecked Customer Care SMS consent checkbox.

The checkbox disclosure identifies DFSENDER, describes the messaging purposes, states that message frequency varies and message and data rates may apply, explains HELP and STOP instructions, and confirms that consent is not a condition of purchase.

A separate optional checkbox is used for promotional/marketing SMS consent.

A separate required checkbox may be used to accept DFSENDER’s Terms of Service and acknowledge this Privacy Policy. Acceptance of those documents does not constitute SMS consent.

The booking may be submitted without selecting either SMS consent checkbox.

Verbal Consent Through Our AI Phone Receptionist

Customers who call DFSENDER at +1 (336) 864-9653 may be offered enrollment in the DFSENDER Customer Care SMS program during telephone bookings.

Before completing a booking that requires legal acceptance, the AI receptionist provides DFSENDER’s Terms of Service and Privacy Policy references and separately requests acceptance of the Terms of Service and acknowledgment of the Privacy Policy.

Terms of Service: https://dfsender.com/terms/

Privacy Policy: https://dfsender.com/privacy/

The receptionist then provides the Customer Care SMS disclosure, including the sender’s identity, messaging purposes, recurring-message frequency, possible message and data charges, HELP and STOP instructions, the voluntary nature of enrollment, and DFSENDER’s mobile-information non-sharing commitment.

SMS consent is requested separately from acceptance of the Terms of Service and acknowledgment of the Privacy Policy.

Enrollment occurs only after the caller clearly and affirmatively agrees to receive Customer Care SMS messages.

Declining SMS consent does not prevent a caller from completing a booking for which the applicable service requirements have been satisfied.

DFSENDER may maintain separate records of legal acceptance, Privacy Policy acknowledgment, and SMS consent, as described in Section 7.

Verbal Customer Care SMS consent does not authorize promotional or marketing SMS messages.

6.2 Promotional and Marketing SMS

Where offered, DFSENDER may separately provide an optional promotional/marketing SMS/MMS consent option.

Marketing communications may include promotions, offers, announcements, and information concerning DFSENDER’s Services consistent with the consent provided.

Selecting Customer Care SMS does not enroll you in promotional/marketing SMS.

Likewise, accepting DFSENDER’s Terms of Service, acknowledging this Privacy Policy, making a purchase, providing a mobile number, or consenting to transactional/informational SMS does not by itself constitute promotional/marketing SMS consent.

6.3 Message Frequency and Charges

Message frequency varies depending upon your interactions with DFSENDER, Services requested, and the messaging program in which you enroll.

Message and data rates may apply.

Your wireless carrier may impose message, data, roaming, or other charges under your wireless plan.

6.4 STOP — Opting Out

You may withdraw SMS consent at any time by replying STOP to a DFSENDER message.

DFSENDER or its messaging provider may send one final confirmation that your opt-out has been processed.

After the opt-out becomes effective, DFSENDER will not send further SMS/MMS messages covered by that opt-out unless you subsequently provide valid consent again or the communication is otherwise permitted by applicable law.

Other standard opt-out keywords may be recognized where supported by the applicable messaging provider.

If you wish to be removed from receiving future SMS communications from DFSENDER, you can opt out by texting STOP.

An SMS opt-out does not cancel an existing Service, booking, transaction, agreement, invoice, or payment obligation.

DFSENDER may continue communicating through other channels where permitted by law.

6.5 HELP

For assistance concerning DFSENDER SMS communications, reply HELP.

You may also contact:

Email: [email protected]
Telephone: 469-638-5060

6.6 START and Re-Enrollment

Where supported, replying START or using another DFSENDER-provided opt-in mechanism may restore eligible messaging.

Re-enrollment applies only to the program and messaging purposes for which valid consent has been obtained.

Re-enrollment in transactional/informational SMS does not automatically constitute consent to promotional/marketing SMS.

6.7 Consent Is Sender- and Purpose-Specific

SMS consent applies only to:

  • DFSENDER LLC as the sender;
  • the applicable mobile telephone number;
  • the messaging program selected; and
  • the purposes disclosed when consent was provided.

Consent is not automatically transferable or expandable to another business, sender, affiliate, brand, campaign, or materially different message purpose.

If the nature or subject matter of recurring messages materially changes in a manner requiring new consent, DFSENDER will obtain the consent required by applicable law and messaging requirements before relying on that change.

6.8 Carrier and Delivery Information

Carriers are not liable for delayed or undelivered messages.

Message delivery depends upon your wireless carrier, device, network availability, coverage, telephone-number status, and third-party infrastructure.

DFSENDER does not guarantee delivery of any particular SMS/MMS message.

7. SMS Consent and Compliance Records

DFSENDER maintains records reasonably necessary to demonstrate that SMS/MMS communications were authorized, administer communication preferences, honor opt-out requests, resolve disputes, and comply with applicable legal, telecommunications-carrier, and messaging-provider requirements.

Consent records may be collected and maintained through DFSENDER’s online booking forms, AI phone receptionist, Office-X platform, and connected communications services.

7.1 General Consent Records

Depending on the consent method, DFSENDER may maintain:

  • The customer’s mobile telephone number;
  • The identity of the messaging sender;
  • The applicable messaging program;
  • The communication purposes authorized;
  • Consent status;
  • Date and time of consent;
  • Consent collection method;
  • The consent disclosure presented or spoken;
  • The applicable consent disclosure or script version;
  • Records of consent withdrawal;
  • Opt-in and opt-out activity;
  • HELP and START requests;
  • Message delivery information; and
  • Other information reasonably necessary to demonstrate and administer consent.

7.2 Online Booking Consent and Acceptance Records

When DFSENDER collects communication consent and legal acceptance through an online booking form, DFSENDER may maintain separate records of the following:

Terms of Service Acceptance and Privacy Policy Acknowledgment

  • The Terms of Service version presented or linked;
  • The Privacy Policy version presented or linked;
  • Whether the required legal acceptance checkbox was affirmatively selected;
  • The date and time of acceptance;
  • The applicable booking or form reference; and
  • Related audit information.

Customer Care and Promotional SMS Consent

  • The customer’s mobile telephone number;
  • The applicable messaging program;
  • Whether the optional Customer Care SMS checkbox was affirmatively selected;
  • Whether the separate optional promotional/marketing SMS checkbox was affirmatively selected;
  • The consent disclosures presented for each program;
  • The date and time of consent;
  • The form or page through which consent was collected;
  • Relevant IP address, browser, or device information; and
  • Related consent and audit records.

Separate Consent Requirements

Acceptance of DFSENDER’s Terms of Service and acknowledgment of its Privacy Policy do not constitute consent to receive SMS/MMS or marketing communications.

Submitting a booking without affirmatively selecting the applicable optional SMS checkbox does not constitute enrollment in that messaging program.

Consent to Customer Care SMS and consent to promotional/marketing SMS are recorded and managed separately.

DFSENDER may maintain these records as reasonably necessary to demonstrate legal acceptance, document communication preferences, comply with applicable requirements, and resolve disputes.

7.3 AI Phone Receptionist Consent and Acceptance Records

When DFSENDER conducts telephone bookings through its AI phone receptionist, DFSENDER may maintain separate records concerning:

Terms of Service Acceptance and Privacy Policy Acknowledgment

  • The Terms of Service version presented or referenced;
  • The Privacy Policy version presented or referenced;
  • The date and time of the caller’s acknowledgment or acceptance;
  • The caller’s response;
  • The applicable call or session reference; and
  • Other information reasonably necessary to demonstrate legal acceptance or acknowledgment.

Customer Care SMS Consent

  • The customer’s mobile telephone number;
  • The applicable messaging program;
  • The date and time of the consent request;
  • The verbal messaging disclosure or script version used;
  • Confirmation that the Terms of Service and Privacy Policy references were included in the verbal disclosure;
  • The caller’s affirmative, negative, or unclear response;
  • The resulting SMS consent status; and
  • Relevant call transcripts, recordings, or other supporting evidence where lawfully collected and retained.

DFSENDER records SMS enrollment only when the caller provides a clear affirmative response specifically authorizing the disclosed Customer Care SMS program.

Acceptance of the Terms of Service or acknowledgment of the Privacy Policy is not recorded or treated as SMS consent.

Silence, an ambiguous response, or merely providing a telephone number does not constitute SMS consent.

DFSENDER processes and retains these records according to applicable privacy, security, call-recording, and record-retention requirements.

7.4 Consent Scope and Restrictions

Consent is specific to DFSENDER, the applicable telephone number, messaging program, and communication purposes disclosed when consent was obtained.

Consent collected for the Customer Care SMS program does not authorize promotional or marketing SMS.

Consent obtained through one method does not automatically expand the purposes or scope of consent obtained through another method.

DFSENDER does not share, sell, rent, or provide mobile phone numbers, text-messaging originator opt-in data, or messaging consent information to third parties or affiliates for their marketing or promotional purposes.

7.5 Opt-Out and Suppression Records

DFSENDER may maintain records of STOP requests, consent withdrawals, and other communication-preference changes.

After an opt-out becomes effective, DFSENDER will not send further SMS/MMS messages covered by that opt-out unless the individual subsequently provides valid consent again or a communication is otherwise permitted by applicable law.

DFSENDER may retain limited suppression or opt-out records after other personal information has been deleted where reasonably necessary to continue honoring the individual’s communication preferences.

7.6 Record Retention and Security

DFSENDER retains consent and compliance records for as long as reasonably necessary to demonstrate authorization, comply with applicable legal and messaging-provider requirements, maintain suppression records, investigate complaints, and resolve disputes.

Records may be processed through Office-X and other operational service providers acting on DFSENDER’s behalf.

DFSENDER applies reasonable administrative, technical, and organizational safeguards to protect these records and restrict access to authorized personnel and service providers.

Additional information about retention and security is provided in Sections 12 and 13 of this Policy.

8. Service Providers and Operational Processing

DFSENDER LLC uses service providers to operate and support the Services. These service providers may process personal information on DFSENDER’s behalf only as reasonably necessary to provide their services, support DFSENDER’s operations, maintain security, process transactions, deliver communications, or comply with applicable law.

The service-provider relationships described in this Section are for operational purposes. DFSENDER LLC does not share, sell, rent, or provide mobile phone numbers, SMS/MMS opt-in information, text-messaging originator opt-in data, or messaging consent data to third parties or affiliates for their marketing or promotional purposes.

Service providers that process mobile information or messaging consent on DFSENDER’s behalf may use that information only as necessary to provide, maintain, secure, or support DFSENDER’s messaging services or as otherwise required by law. They are not authorized by DFSENDER to use that information for their own marketing or promotional purposes.

8.1 Office-X LLC

DFSENDER uses the Office-X software platform to administer portions of its customer, booking, service, communication, document, electronic-signature, invoice, payment, and related business workflows.

Office-X LLC acts as a service provider or processor to DFSENDER and may process personal information on DFSENDER’s behalf, including information relating to:

  • customers and customer records;
  • requests, bookings, and appointments;
  • projects and tasks;
  • communications;
  • documents and electronic signatures;
  • estimates and agreements;
  • invoices and transaction status;
  • communication preferences;
  • email and SMS/MMS consent;
  • opt-in and opt-out records; and
  • related operational, security, and audit records.

Office-X processes this information to provide and support technology services used by DFSENDER. Office-X is not authorized by DFSENDER to use DFSENDER customers’ mobile phone numbers or messaging consent data for its own marketing or promotional purposes.

DFSENDER remains responsible for its customer relationship and its own use of personal information.

8.2 Messaging Service Providers

DFSENDER may use communications and telecommunications service providers, including Twilio or Telzio, to operate and support SMS/MMS communications.

These providers may process limited information on DFSENDER’s behalf, such as:

  • mobile phone numbers;
  • message content;
  • message delivery and routing information;
  • messaging preferences;
  • opt-in and opt-out status; and
  • information reasonably necessary to operate, secure, route, deliver, and support the messaging service.

Other telecommunications carriers and messaging infrastructure providers may also process information as technically necessary to transmit and deliver messages.

These operational service providers are not authorized by DFSENDER to use mobile information or messaging consent data for their own marketing or promotional purposes.

DFSENDER does not share, sell, rent, or provide mobile phone numbers or messaging consent data to third parties or affiliates for marketing or promotional purposes.

8.3 Email Service Providers

DFSENDER may use email or SMTP service providers to send and receive communications.

These providers may process email addresses, message content, delivery information, and related technical information as reasonably necessary to route, deliver, secure, and support email communications on DFSENDER’s behalf.

8.4 Payment Processors

DFSENDER may use payment processors such as Stripe or PayPal to process authorized payments.

Payment processors generally collect and process payment credentials directly under their own terms and privacy practices.

DFSENDER may receive limited transaction information, including:

  • transaction identifiers;
  • transaction amounts;
  • currency;
  • payment status;
  • refund information;
  • dispute or chargeback information; and
  • other information reasonably necessary to administer the transaction.

DFSENDER does not generally receive or store complete payment-card credentials merely because a customer makes a payment through a DFSENDER payment interface.

8.5 Other Operational Service Providers

DFSENDER may use other service providers that support functions such as:

  • cloud hosting and data storage;
  • cybersecurity and fraud prevention;
  • analytics;
  • scheduling and calendars;
  • document management;
  • electronic signatures;
  • customer support;
  • file delivery;
  • accounting;
  • legal and professional services; and
  • other operational functions necessary to provide or support the Services.

These providers may process personal information only as reasonably necessary to perform the applicable services for DFSENDER or as otherwise permitted or required by law.

Nothing in this Section authorizes any service provider, third party, or affiliate to use DFSENDER customers’ mobile phone numbers, SMS/MMS opt-in information, or messaging consent data for its own marketing or promotional purposes.

8.6 Legal and Compliance Disclosures

DFSENDER may disclose personal information when reasonably necessary to:

  • comply with applicable law, regulation, court order, subpoena, or other lawful process;
  • respond to a lawful government request;
  • protect the rights, property, security, or safety of DFSENDER, our customers, or others;
  • investigate or prevent fraud, abuse, security incidents, or unlawful activity;
  • establish, exercise, or defend legal claims;
  • enforce agreements; or
  • comply with applicable telecommunications, carrier, or messaging-program requirements.

These legal and compliance disclosures do not authorize the recipient to use mobile information or messaging consent for marketing or promotional purposes.

8.7 Business Transactions

Personal information may be processed or disclosed as reasonably necessary to evaluate or complete a financing, merger, acquisition, restructuring, reorganization, bankruptcy, sale of assets, or similar business transaction, subject to applicable law.

A business transaction does not by itself authorize a different sender, brand, affiliate, or other party to use your mobile phone number or existing SMS/MMS consent for its own marketing or promotional messages. Any new consent required by applicable law must be obtained before such messaging occurs.

9. Mobile Information and SMS Consent — Non-Sharing Rule

Because this provision is important to our messaging practices, we state it separately and expressly:

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes.

DFSENDER will not sell, rent, share, transfer, or provide your mobile phone number, text-messaging originator opt-in data, or SMS/MMS consent to third parties or affiliates for their own marketing or promotional purposes.

All categories of information sharing described elsewhere in this Policy exclude text-messaging originator opt-in data and consent from sharing with third parties or affiliates for marketing or promotional purposes.

DFSENDER may provide limited mobile information to Office-X, Twilio, Telzio, telecommunications carriers, messaging aggregators, The Campaign Registry, compliance providers, and other service providers solely as reasonably necessary to provide, register, route, deliver, secure, monitor, and support DFSENDER’s messaging services; maintain consent records; honor messaging preferences; prevent fraud or abuse; or comply with applicable law and carrier requirements.

Those operational disclosures do not permit those recipients to use DFSENDER customer mobile information or SMS consent for their own marketing or promotional purposes.

10. Cookies and Similar Technologies

DFSENDER and providers supporting our websites and online Services may use cookies and similar technologies, such as pixels, tags, local storage, and analytics technologies.

These technologies may be used to:

  • maintain sessions;
  • remember preferences;
  • enable website functionality;
  • authenticate users;
  • secure websites and Services;
  • prevent fraud;
  • understand website usage;
  • diagnose errors;
  • measure performance;
  • improve Services; and
  • where permitted, measure advertising or marketing effectiveness.

Cookies may collect information such as IP address, device and browser information, session identifiers, referring pages, pages visited, interactions, and dates and times of activity.

You may be able to control cookies through your browser settings and, where available, our cookie or privacy controls.

Blocking certain cookies may affect website or Service functionality.

11. Sale, Sharing, Targeted Advertising, and Opt-Out Signals

DFSENDER does not sell personal information for money.

DFSENDER does not sell or share mobile information or SMS opt-in information for third-party marketing or promotional purposes as described in this Policy.

If DFSENDER engages in activities that constitute “sale,” “sharing,” “targeted advertising,” or similar regulated activity under an applicable U.S. state privacy law, we will provide any notice and opt-out mechanism required by that law.

Where required and technically applicable, DFSENDER will recognize legally required browser-based opt-out preference signals, including Global Privacy Control (GPC).

Browser “Do Not Track” signals are not uniformly defined or legally standardized. We respond to such signals where required by applicable law.

12. Data Retention

DFSENDER retains personal information for only as long as reasonably necessary for the purposes for which it was collected or another lawful business purpose.

Retention periods may vary depending upon the type of information and may reflect the need to:

  • provide Services;
  • maintain customer records;
  • maintain financial and transaction records;
  • comply with tax and accounting obligations;
  • administer agreements;
  • maintain electronic-signature records;
  • maintain communication records;
  • establish SMS and email consent;
  • honor opt-outs;
  • maintain suppression records;
  • maintain security and audit records;
  • satisfy carrier and messaging-provider requirements;
  • prevent fraud;
  • resolve disputes;
  • establish or defend legal claims; and
  • comply with applicable law.

We retain evidence of communication consent for as long as reasonably necessary to demonstrate the consent and as necessary to satisfy applicable legal and messaging-provider requirements.

Withdrawal of consent does not necessarily require deletion of the historical record demonstrating that consent existed before withdrawal.

We may retain a minimal suppression or opt-out record after an opt-out so that we can continue honoring your preference.

When information is no longer reasonably necessary, we may delete, de-identify, aggregate, or securely dispose of it, subject to lawful holds and reasonable backup cycles.

13. Data Security

DFSENDER uses reasonable administrative, technical, and organizational safeguards designed to protect personal information appropriate to the nature of the information and our Services.

Depending upon the system and circumstances, safeguards may include access controls, authentication, authorization controls, logging, monitoring, secure communications, provider security controls, personnel restrictions, and other reasonable measures.

We limit access to personal information to personnel and service providers that reasonably require access for legitimate business purposes.

However, no internet transmission, information system, or electronic storage system can be guaranteed to be completely secure.

If you believe your interaction with DFSENDER or your personal information may have been compromised, please contact us promptly at [email protected].

15. California Privacy Information

If the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA/CPRA“), applies to DFSENDER’s processing of your information, California residents may have rights including access, correction, deletion, portability, and the right to opt out of sale or sharing, subject to statutory limitations.

During the preceding 12 months, DFSENDER may have collected the categories of personal information described in Section 1 from the sources described in Section 2 and used them for the purposes described in Section 3.

DFSENDER may disclose applicable categories of personal information for business purposes to the categories of recipients identified in Section 8.

DFSENDER does not sell or share mobile phone numbers, SMS opt-in information, or messaging consent with third parties or affiliates for their marketing or promotional purposes.

DFSENDER does not knowingly sell or share the personal information of consumers under 18.

DFSENDER does not use or disclose sensitive personal information for purposes of inferring characteristics in a manner that would create a right to limit under California law unless we provide the legally required notice and choice.

20. Third-Party Websites, Integrations, and Services

DFSENDER’s Services may contain links to or integrate with third-party websites and services.

When a third party independently determines how it collects or processes your information, its own privacy policy and terms govern that processing.

Examples may include payment processors, third-party authentication services, communications providers, or other independently controlled services.

This Privacy Policy does not govern an independent third party’s privacy practices.

21. Relationship to DFSENDER Terms of Service

This Privacy Policy describes DFSENDER’s privacy and personal-information practices.

DFSENDER’s Terms of Service separately govern the contractual relationship concerning DFSENDER’s Services, including electronic communications, messaging terms, payments, liability, disputes, and other contractual matters.

Acceptance of the Terms of Service and acknowledgment of this Privacy Policy does not by itself constitute consent to marketing email, transactional/informational SMS/MMS, or promotional/marketing SMS/MMS.

Where communication consent is required, DFSENDER obtains it separately as described in this Policy and the Terms of Service.

22. Changes to This Privacy Policy

DFSENDER may update this Privacy Policy from time to time to reflect changes in:

  • our Services;

  • communication programs;
  • privacy requirements; or
  • applicable law.

We will publish the revised Policy with an updated effective or “Last Updated” date.

Where applicable law requires additional notice, we will provide that notice.

If a change would require new or expanded consent for SMS/MMS, email marketing, or another regulated communication, publication of an updated Privacy Policy alone will not constitute that consent. DFSENDER will obtain the consent required by applicable law before relying upon the change for those communications.
